Terms of Use

These Terms of Use (“Terms”) govern access to and use of the NAUTPLUS site and the waitlist, provided by NautPlus Tecnologia Náutica Ltda. (“NAUTPLUS”, “we”).

By accessing the site, joining the waitlist, or interacting with us, you (“user”, “you”) declare that you have read, understood, and accepted these Terms and our Privacy Policy. If you do not agree, do not use the site.

• Site: the pages and resources available on NAUTPLUS domains.
• Platform: the NAUTPLUS application and services, under development and to be launched in the future.
• Waitlist: the advance registration of parties interested in the Platform launch.
• Content: texts, trademarks, logos, images, layout, software, and other elements of the site.

The NAUTPLUS Platform is in operation, with access by invitation. The site is informational and allows waitlist registration, which sets the order of invitations per persona.

Not every feature presented on the site is available today. Those that do not yet exist are identified as such on the pages themselves — this is the case for the ESG section and the shipyard or manufacturer profile — and may change, be delayed, or not be launched. The remainder are operational and may evolve.

Waitlist registration does not guarantee access to the Platform, a deadline to receive the invitation, a price, or any commercial condition. Commercial conditions are presented at the time of purchase.

• You must be at least 18 years old and have legal capacity to register;
• The information provided must be true, accurate, and up to date;
• You are responsible for the information you provide and for your use of the site;
• We may refuse, suspend, or cancel registrations that violate these Terms or the law.

When using the site, you agree not to:

• violate laws, third-party rights, or these Terms;
• provide false information or impersonate another person;
• attempt to access restricted areas, bypass security measures, or overload the infrastructure;
• introduce malware, perform unauthorized automated collection (scraping), or reverse engineering;
• use the site to send spam or unlawful, offensive content, or content that infringes third-party rights.

The NAUTPLUS trademark, logo, name, design, texts, and other elements of the site belong to NAUTPLUS or its licensors and are protected by intellectual property law. Copying, reproducing, distributing, modifying, or commercially exploiting any content without prior written authorization is prohibited.

By sending us information, suggestions, or feedback, you declare that you hold the necessary rights and grant us a free, non-exclusive, indefinite-term license to use them to operate and improve NAUTPLUS, subject to the Privacy Policy. You remain responsible for the content you submit.

We strive to keep the site available and accurate, but it is provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation, nor that features identified on the site as planned or under construction will actually be implemented. We may change, suspend, or discontinue the site or part of it at any time.

To the maximum extent permitted by law, NAUTPLUS is not liable for indirect damages, lost profits, data loss, or losses arising from the use or inability to use the site, from unavailability, or from third-party content and linked external sites. Nothing in these Terms excludes liabilities that cannot be waived under the law, including those set out in the Consumer Protection Code.

The site may contain links to third-party pages and services, such as social networks and WhatsApp. We do not control or answer for their content and policies. Access to them is your responsibility and subject to the terms of the respective providers.

By registering, you may receive communications related to NAUTPLUS. Marketing communications depend on your consent and may be canceled at any time via the unsubscribe link or by request. Essential communications, such as service notices, may be sent regardless of the marketing option.

The processing of your personal data is governed by our Privacy Policy, which is part of these Terms. We recommend reading it to understand how we collect, use, and protect your data, and what your rights are under the LGPD.

When the Platform begins offering paid online purchases, you may exercise the right of withdrawal set out in art. 49 of the Consumer Protection Code, canceling the purchase within 7 (seven) days of the contract or receipt, as applicable. The specific conditions will be informed at the time of purchase.

We may change these Terms at any time. The current version will always be published on this page, with the date of the last update. Continued use of the site after changes represents agreement with the new version. If you do not agree, you must stop using the site.

These Terms remain in force while you use the site. We may terminate or suspend your access in the event of a violation. You may, at any time, request deletion of your waitlist registration, as described in the Privacy Policy.

These Terms are governed by Brazilian law, in particular the Civil Rights Framework for the Internet (Law No. 12,965/2014), the Consumer Protection Code (Law No. 8,078/1990), and the LGPD (Law No. 13,709/2018). The courts of the consumer's domicile are elected to settle any disputes, in accordance with consumer law.
